Conditions
Under our Express Warranty all building materials used in the construction of Saramark buildings are covered for a period of ten (10) years and shall be free from faults or defects. The Express Warranty period shall begin at the date of substantial completion as noted above. For the purpose of warranty, substantial completion shall mean the date you take beneficial use and occupancy of the building.

In the event that you discover a condition which you believe falls within the warranty, it is your responsibility under this warranty to take reasonable steps to protect the Saramark building(s) from further damage. This time frame includes the date a warranted condition is discovered and the date it is reported to the Saramark information center at the number provided below. If your question is not resolved over the phone and warranty service is required, you will be referred to the nearest Saramark Authorized Service Provider.

During the warranty period, Saramark will, at no additional charge to you, repair and/or replace defective parts with new or reconditioned parts at our discretion. Reconditioned parts will be equal in performance to the original parts. Saramark is entitled to keep all original parts and products which are replaced by Saramark or its Authorized Service Providers.

If Saramark or one of its Authorized Service Providers determines that the repairs required are not covered by this warranty or written extension thereof, you will be notified of the same.

Thereafter, if you authorize Saramark or one of its Authorized Service Providers to perform the necessary repairs, you will be responsible for paying Saramark or its Authorized Service Provider at their rates at the time the repairs are performed.

Disclaimer of Warranty
This Saramark, Inc.warranty and all written extensions thereof do not include service, repair and/or replacement to correct any damage caused by improper installation by others, improper connections or services by others, external electrical fault, misuse, abuse or modifications to the building without prior written approval from Saramark. The failure to perform periodic and regular preventative maintenance to the building(s) will void the Express Warranty.

All other express or implied warranties, including,without limitation, the implied warranty of merchantability and/or the implied warranty of fitness for a practical purpose are hereby disclaimed. There are no other warranties which extend beyond the Express Warranty contained herein.

Limitation of Remedy
If the Saramark building(s), or any component thereof, is not as warranted, the sole and exclusive remedy of the owner shall be the repair or replacement of the defective part(s). The owner acknowledges and understands that in no event shall Saramark or any Authorized Dealer,Distributor or Service Provider of Saramark, Inc., be liable for any damages in excess of the purchase price of the product. This limitation of damages applies to direct or indirect damages of any kind, including, but not limited to lost profits, or other special, incidental, exemplary or consequential damages whether for breach of contract, tort, or otherwise, or whether arising out of the use of or inability to use the product, even if Saramark and/or any Authorized Dealer,Distributor and/or Service Provider was advised of the possibility of such damages or any potential claim by owner or any other party. Saramark further disclaims any and all liability arising out of the change and/or elimination of any Authorized Dealer,Distributor and/or Service Provider of this product.
